Focus Nordic care about your privacy and want you to feel safe in how we handle your personal data. The EU/EEA data regulation GDPR, effective from May 25th 2018, have positive effects for your privacy. Our privacy policy clarifies how we handle personal data and how the data is protected in a responsible, secure and correct way according to the laws and regulations. We also present what personal rights you as an individual have towards us, and how you may use these rights from May 25th 2018.

Your personal data have always been handled carefully by us and safely stored in our databases. However, GDPR will give you the possibility to influence how we handle your data. Read more about our work in our privacy policy or contact our data protection officer at GDPR@focusnordic.com.

 

General information

Focus Nordic AB (Hereafter; “Focus Nordic”, “we”, “us”, or “our”) takes the protection of the privacy of every individual very seriously to make sure that you as a customer and visitor to our platforms can feel confident and safe about how we process personal data. This Privacy Policy summarises all details regarding how we collect, store and process your personal data in the context of your visiting our website, purchasing products, or in another way establishing contact with us. It also explains the rights you have as an individual and how you can exercise them. The Policy is intended for our current and future customers, jobseekers, and visitors to our platforms – and it has been composed in accordance with the EU/EEA General Data Protection Regulation (GDPR). Processing personal data

What is personal data?

“Personal data” refers to all personal information that can be used to directly (or indirectly, combined with other data) identify a natural person. It might be names, identity numbers (social security numbers), email addresses, or home addresses, for example.

Who is responsible for the personal data we collect?

We, Focus Nordic AB (business ID 556507-4985), are responsible for all personal data collected and processed by us, and it is our responsibility that such collection and processing be performed in accordance with applicable laws.

How do we process personal data?

We handle all data collected in a responsibly, safely, and correct way, so that you as an individual can feel confident and safe while visiting our platforms and purchasing from us. Focus Nordic is the data controller, which means that we have a responsibility to ensure the safe processing of the data in accordance with applicable laws and regulations in this area.

Regardless of the nature of the data collected, it is processed in a uniform way, structured, and stored in any of our databases. The data may be processed further and transferred from one database to another, but it will be treated in the same responsible, safe, and correct way regardless of storage location.

How long do we store your personal data?

 As a rule, Focus Nordic only stores and processes personal data for as long as is necessary or for as long as we are required to by applicable legislation. The potential length of this storage period varies based on the purpose of the storage and processing of the data. In the case of a dispute or suspicion that a crime may have been committed, the data may be stored for longer to defend, verify, or make legal claims.

We handle all personal data that is collected in a responsible, secure and correct way in order for you to feel safe when visiting our platforms and purchasing our merchandise. Focus Nordic as a data controller is responsible, in regards to current laws and regulations, to ensure this handling by securing the data processed.

Personal data includes all types of information that can be identified, either separately or in combination, with a specific human being. For instance, this can be personal data such as name, personal identification number, email address or residential address. Regardless of what data we collect and process we make sure that the data is securely handled, structured and stored in any of our databases. We may transfer data between several different databases, although still handled in the same responsible, secure and correct way regardless of the location.

Customer accounts and processing orders

We are obliged to handle and store a variety of personal data when selling merchandise, in order to finalize orders and deliveries as well as to ensure warranties. Should we not receive this data or permission to store and process the data, we cannot process your order. As a customer, your order will then be declined. You must therefore accept our terms to purchase from us.

The storage and use of certain contact information is necessary to send you details regarding your order. These details consist of offers, order confirmations, shipment notices, and all information and documentation related to invoicing and crediting. The following data may be stored from an order:

  • Name
  • Invoicing address
  • Shipping address
  • Phone number
  • Email address
  • IP address

An order remains active in our databases until it is fully delivered, whereupon it will be archived. Focus Nordic stores archived orders to ensure the completion of the delivery as well as to process any returns, complaints, and warranty-related matters.

Complaints and service matters

When Focus Nordic receives information about complaints and service matters, we require access to personal data in order to provide our services. Should the individual filing the matter not consent to our storage of their data, the data will be deleted after the matter has been closed. Should they instead give their consent, we will store the data until further notice or until the warranty period has ended. The following data may be stored in connection to a complaint or service matter:

  • Identity number
  • Name
  • Invoicing address
  • Shipping address
  • Phone number
  • Email address
  • IP address

Campaigns and prize draws

Focus Nordic organises various campaigns and contests that may be relevant for our customers, our customers’ customers, and/or other consumers. In these cases we will store personal data until the campaign or contest is fully over as far as Focus Nordic is concerned, whereafter we will remove all data that is not a part of our commercial transactions. For more details on our legal basis, please see section 2.6 Legal basis.

We will ask each individual to consent to our storage of this personal data over this period in order for them to participate in these campaigns and contests. The following data may be stored in connection to a campaign or contest:

  • Identity number
  • Name
  • Invoicing address
  • Shipping address
  • Phone number
  • Email address
  • Bank account information

Jobseekers

Upon receiving job applications from individuals, we will store the information for as long as the matter is ongoing. If the application is declined, we will delete all information and save nothing in any of our databases, physically or electronically. There may be exceptions to this in the case that the applicant requests we save their data for future needs. The request will be treated as consent to store their data. If the applicant becomes a Focus Nordic employee, we will transfer their data to our databases. There it will be stored with the legal basis being the storage of the personal data of employees and affiliated persons for as long as the individual remains an employee. After termination of employment data we can no longer use will be deleted, barring data we are legally obligated to store. The following data may be stored in connection to a job application:

  • Identity number
  • Name
  • Residence address
  • Phone number
  • Email address

Communications and messages

Focus Nordic keeps a contact register to send out communications, such as general information, announcements, campaigns, etc. In this register we store personal data from persons, both private individuals and corporate representatives. We additionally store information on whether or not a given person wishes to receive communications from us, which guides communication between the parties. Should a person consent to us sending them information via email, we will do so until further notice. The following data may be stored in this register:

  • Name
  • Shipping address
  • Phone number
  • Email address

Social media

To manage advertisements and customer contacts on social media, we use your personal data when you interact with features in third-party social networks, such as like and comment functions on platforms like Facebook, Instagram, and YouTube. You can always find out more about the features and the profile information we may receive from you as well as how you can opt out of sharing these details by reading the social networks’ privacy policies.

Legal basis

Legal obligation: Like all businesses, Focus Nordic has a legal basis to store commercial transactions between us and our customers based on accounting legislation and/or applicable tax legislation. Hence if we are not given the necessary data, we cannot fulfil our legal obligations and therefore cannot perform commercial transactions between the parties.

Contractual obligation: Focus Nordic has a legal basis to collect and process personal data in order to perform sales contracts with customers, manage customer service and complaints, create and manage customer accounts, and organise and manage contests.

Legitimate interest:  Focus Nordic has a legal basis to collect and store personal data for direct marketing in the case of legitimate interest. You are free to reach out to us to dispute this interest, in which case we are obligated to desist.

Can children use our services?

Our website and our services are not meant for underage children. We do not intentionally collect information, such as personal data, from children or other persons who do not have a legal right to use our website or services. Should we learn that we may have received the personal data of an underage child, we will delete it unless we are obligated by law to store it. Should you believe us to have inadvertently collected the personal data of an underage child, please contact us at GDPR@focusnordic.com.

Sharing personal data

Focus Nordic cooperates with several partner organisations who have regulated access to our databases. We have contracts with all of these partner organisations obliging them to pursue the secrecy and privacy that both they and we have a duty to uphold. We mostly share personal data within the EU/EEA, but may also share personal data outside this area in the case that our partner organisations are located / store data outside the EU/EEA. Even in such cases Focus Nordic has taken all measures required by law to transfer personal data via contracts with our partner organisations to ensure their compliance with EU standard contractual clauses. Focus Nordic controls who has access to personal data among our various partner organisations, ensuring the responsible, safe, and correct processing of the data. We grant our partner organisations access to our databases for the following purposes:

  • Support & troubleshooting
  • Development
  • Maintenance
  • Upgrades and implementations
  • Integration between databases
  • Backup services
  • Finalizing shipments

Your rights

As a customer and visitor on our platforms, you may use your rights to receive any of the personal data we have stored about you at any time. At your request, we will provide you with all the information we have stored regarding you. You also have the right to correct the information by deleting some or all of it, or by adding any information we might be missing.

When you initiate a request to access your personal data from us, you also have the right to further information related to your data. This further information may consist our purposes for storing your personal data, who has been given access to your data, or from where we have received the information, if it origins from some other party then yourself.

You can use these rights at any time of your choosing by sending an email to our data protection officer at GDPR@focusnordic.com.

Should you consider us to have committed an error in our processing of personal data, you can apply a complaint to the responsible authority in your country.

Amendments to this privacy policy

Focus Nordic has the right to make amendments to this Privacy Policy at any time and update frequency. The latest, most up-to-date version is always available here. In the case of substantial amendments we will inform you via email of their nature as well as the date the new version enters into force.

Focus Nordic reserve the right to update our privacy policy at any time with any frequency. The latest version will always be available at our website. For larger changes in the privacy policy we will communicate these through email, including what date the new version takes place from.
